TERMS & CONDITIONS OF SERVICE AGREEMENT:
By accessing this site and availing our services, you hereby agree that you have read, and agree to comply with and be bound by, the terms of this agreement in their entirety without limitation or qualification as well as all applicable laws and regulations. If in case you do not wish to comply with the aforementioned kindly do not access the website or avail the services provided herein.
CONFIDENTIALITY POLICY :-

1. The identity of the client will be kept confidential in all cases other than where identity of the client or any details thereof are required to be disclosed as mandated by law. However, no personal identifying information will be used for any commercial purpose(s).
2. The information provided by the client in the due course of his/her sessions will be kept confidential, except in circumstances where the same shall be required to be disclosed by operation or mandate of law.
3. The contract of confidentiality will cease to bound Pratinava and the MHP:

If the client has or shows suicidal or homicidal tendencies; or

If the client is of harm to self, others or property; or
-
Under all circumstances as laid down in the Mental Healthcare Act, 2017 as well as any other applicable law, rules or regulations for the time being in force in India.

SESSION BOOKING & PAYMENT POLICY :-

4. Pratinava doesn’t encourage last-minute session bookings, and does not guarantee confirmation of a session or availability of an MHP wherein a request for session is made within less than 24 hours of the desired time of the session. All clients must book a session and make the respective payment prior to 24 hours of the session.
5. The payment for each session shall be made by the client before 24 hours of the respective session. However, late session booking and payment shall be accepted, depending upon the availability of the MHP, with an additional surcharge, at the rate of 10% of the standard fees if made between 24-12 hours, 25% of the fees for bookings & payments made between 12-6 hours and 50% of the initial fees in cases where booking & payment is made between 6-0 hours of the session.
6. All payments by clients shall be made to Ishan Foundation - Pratinava's Bank Account. Payments made to any other account shall not be recognised and accepted as valid payments under any circumstances.
7. In all cases of non-payment or non-timely payment, as the case may be, the session shall be considered to be cancelled and will then be rescheduled considering the MHP's availability.

CANCELLATION POLICY :-

8. For cancellation or rescheduling of a session by a client, he shall request the same to Pratinava through the official WhatsApp or Instagram Account prior to 24 hours of the scheduled beginning of the session. Depending upon the availability of the MHP, Pratinava shall cancel and/or reschedule the session, as the case may be.
9. Any late request for cancellation or rescheduling the session shall attract a forfeiture of a part of the fees as ‘cancellation or rescheduling charges’ paid by the client. Further, no refund shall be made for the balance of the fees, however, the same shall be adjusted towards the payment of the next session of the client.
10. Any cancellation and/or rescheduling request made within 24-12 hours of the scheduled time of the session shall attract a forfeiture of 20% of the fees paid, 25% of the fees for such requests made with 12-6 hours and 50% of the fees paid by the client when such request is made within 6-0 hours of the scheduled time of the session.

GENERAL NORMS TO BE FOLLOWED :-

11. The client is required to be punctual for the session and must join the link or arrive at the mutually decided location within 10 minutes of the scheduled time, with exceptions for emergencies and unavoidable situations after prior information.
12. If the client doesn’t join the link of the session within 15 minutes in case of an online session or does not show up within 25 minutes of an offline session, the same shall lead to forfeiture of 50% and 75% the fees paid by the client as ‘no-show charges’. Further, no refund shall be made for the balance of the fees, however, the same shall be adjusted towards the payment of the next session of the client.
13. The client shall be required to share his emergency contact as and where required. Further, it's a humble suggestion by Pratinava to please share the details of your Mental Health Professional with your emergency contacts. This is to ensure that in case of an unavoidable emergency, your Mental Health Professional can be contacted and your safety can be ensured.
14. Safety of our clients seeking help is of utmost concern and value for Pratinava. If you feel unsafe or uncomfortable at any moment during your journey with the professional, contact us immediately at thepratinavaproject@gmail.com or DM us on Instagram.
15. We hereby clarify that we're not a medical service or a suicide prevention helpline. If in case during the therapy, psychiatric or counselling sessions, the client feels that he have suicidal tendencies, or that his actions can prove to be a danger to you or others around you, we strongly request you to seek immediate help by contacting a concerned mental healthcare authority or a suicide prevention helpline.
